Florida's ADU landscape has changed significantly. State legislation has preempted many local restrictions, making it easier than ever for Tampa Bay homeowners to build an accessory dwelling unit. Here is what you need to know in 2025.
Florida's HB 1339, effective July 2023, requires all Florida municipalities to allow ADUs on any single-family residential lot. Local governments can still regulate setbacks, height, and size, but they cannot outright prohibit ADUs. This is a major change that opened up ADU development across Tampa Bay.
